1. Acceptance of Terms

By accessing or using nontoxiclab.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site. These Terms apply to all visitors, readers, and others who access the Site.

2. Who We Are

NonToxicLab is an independent editorial publication operated by Lara Voss, a sole proprietor based in Ontario, Canada ("we," "us," or "NonToxicLab"). We publish research, reviews, and commentary on consumer products and indoor environmental health.

3. Editorial Content; Not Medical or Professional Advice

The content on the Site is for general informational and educational purposes only. It is not medical, legal, financial, or any other form of professional advice and must not be relied upon as a substitute for advice from a qualified professional. NonToxicLab is not a laboratory, certification body, or regulatory authority. The author is not a licensed toxicologist, physician, or attorney. References to studies, regulations, or expert commentary are for context only and do not constitute an endorsement of any specific product, treatment, or course of action.

4. The Term "Non-Toxic" Is an Editorial Standard

The phrase "non-toxic" is not regulated in the United States or Canada. We use it as an editorial shorthand defined in our Editorial Policy. Our use of the term does not constitute a regulatory certification, a guarantee of safety, or a claim that any product is free of every chemical of concern. Reasonable people may disagree about whether a given product fits the editorial standard, and our judgment may change as new information becomes available.

5. Affiliate Relationships

NonToxicLab participates in the Amazon Services LLC Associates Program and may participate in other affiliate programs. We earn commissions on qualifying purchases made through links on the Site at no additional cost to you. Affiliate participation does not influence our editorial judgment. "NonToxicLab" and the NonToxicLab logo are trademarks of NonToxicLab. Product and brand names mentioned on the Site are the trademarks of their respective owners; reference to a third-party trademark does not imply endorsement of NonToxicLab by the trademark holder.

7. Permitted and Prohibited Use

You may use the Site only for lawful, personal, non-commercial purposes. You agree not to:

• Use automated tools to scrape, copy, or harvest content from the Site, except for AI/search crawlers that respect our robots.txt and llms.txt directives.
• Republish, syndicate, or train commercial AI models on the Site's content without prior written permission.
• Use the Site to violate any law, infringe any intellectual property right, or harass any person.

• Introduce viruses, malware, or other harmful code.

The Site contains links to third-party websites and services that are not owned or controlled by NonToxicLab. We are not responsible for the content, privacy practices, or availability of third-party sites. Your use of any third-party service is at your own risk and is governed by that service's terms.

10. Product Information and Pricing

Product details, prices, ratings, and availability shown on the Site can change without notice and may not reflect what you see when you click through to the retailer. Always confirm price, availability, certifications, and product specifications on the retailer's page before purchasing. We are not the seller of any third-party product. Disputes about a purchase, return, refund, or warranty must be resolved with the retailer or manufacturer, not with NonToxicLab.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, NONTOXICLAB DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND CONTINUOUS AVAILABILITY.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT (A) THE INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT; (B) ANY PRODUCT MENTIONED IS SAFE, EFFECTIVE, OR FIT FOR YOUR PARTICULAR USE; (C) THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; OR (D) ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NONTOXICLAB AND ITS PRINCIPALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100), OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above may not apply to you. In such jurisdictions, our liability is limited to the smallest extent permitted by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless NonToxicLab and its principals from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

14. DMCA Copyright Policy

NonToxicLab respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA") and equivalent Canadian copyright law. If you believe content on the Site infringes your copyright, please send a written notice to our designated agent that includes:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material claimed to be infringing, with a URL or other location on the Site.
4. Your contact information (address, telephone number, email).
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

15. Modifications to the Site and to These Terms

We may modify, suspend, or discontinue the Site (or any part of it) at any time without notice. We may also revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the revised Terms. If a revision is material, we will note the change at the top of this page for at least 30 days.

16. Governing Law and Dispute Resolution

Default rule: These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or the Site shall be resolved exclusively in the courts of Ontario, and you consent to the personal jurisdiction of those courts.

US residents (carve-out): If you are a resident of the United States and prefer to resolve disputes in the United States, you and NonToxicLab agree, at your election, that any dispute may instead be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, with the arbitration seated in your home state and conducted in English. The arbitration award shall be final and enforceable in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the enforceability of this arbitration agreement.

No class actions: All disputes shall be resolved on an individual basis. Class actions, class arbitrations, and consolidated proceedings are not permitted.

Small claims exception: Either party may bring an individual action in small-claims court if it qualifies, regardless of the foregoing.

Nothing in this Section limits any non-waivable rights you may have as a consumer under the laws of your jurisdiction of residence.

17. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

18. Entire Agreement

These Terms, together with the Privacy Policy, Affiliate Disclosure, and Editorial Policy, constitute the entire agreement between you and NonToxicLab regarding the Site and supersede any prior agreements.
